Terms of service

By using In de Zon (the 'Service') you agree to these terms of service. You must be at least 16 years old to use the Service. Please read these terms carefully before using the Service.
1. Use of the service
In the Sun is intended for personal, non-commercial use. You may not use the Service for commercial purposes without the prior written consent of In the Sun.
It is prohibited to:
- automatically read or scrape the Service (crawl, harvest or otherwise gather data through automated means);
- disrupt or overload the operation of the Service;
- use the Service for unlawful purposes or in breach of these terms;
- mislead or harm other users or terrace owners.
In the Sun reserves the right to deny access or deactivate accounts in the event of misuse.
2. Account
To use certain features (favourites, reservations) you must sign in via Clerk with your Google or Apple account (Single Sign-On). You are responsible for the confidentiality of your account credentials and for all activity that takes place under your account.
You must notify In the Sun immediately of any unauthorised use of your account. In the Sun is not liable for damage resulting from unauthorised use caused by failure to comply with this obligation.
You can delete your account at any time via the account settings or by contacting info@indezon.app.
3. Reservations
Via In the Sun you can reserve a table for free at participating terraces. A reservation is only final once confirmed by the terrace.
Cancellation: You can cancel a reservation free of charge up to 1 hour before the reserved time via the app or website.
No-show: In case of repeated failure to cancel and not show up ("no-show"), In the Sun reserves the right to temporarily block your reservation feature. This is to protect terrace owners against unnecessary table occupation.
In the Sun acts solely as an intermediary between user and terrace owner. The actual service (the terrace, the table, the reception) is the responsibility of the terrace owner.
QR code & check-in. Confirmed bookings display a QR code in the app. The owner scans it on arrival to record check-in. Forgot your phone? Just give your name at the table, the owner can manually check you in or out.
Push notifications. With your consent we send confirmations, UV reminders and (unless you opt out) relevant deals from terraces nearby. Push can always be disabled via your phone settings or in the app.
4. Terrace owners
Terrace owners who register their location via the In the Sun Dashboard agree that:
- the information they provide about their terrace (name, location, opening hours, availability) is accurate and up-to-date;
- they are responsible for honouring reservations and for communicating changes in good time;
- they will indemnify In the Sun against claims from users arising from inaccurate information or failure to honour reservations.
In the Sun reserves the right to remove locations from the app that do not meet the quality standards or that repeatedly receive complaints.
Free baseline & paid features. Baseline functionality (on the map, receiving reservations, basic cockpit) is free. The following features are part of paid subscriptions, billed via Stripe: sponsorship tiers (Starter €29/m, Growth €49/m, Pro €129/m), Coach Pro (€19/m), Lead Intelligence (€29/m), and a booking-fee per confirmed reservation (€0.50, or €0.375 with Growth/Pro). Current prices and contract terms are shown in the Owner dashboard.
Ownership verification. Before an owner can claim a terrace, we verify ownership (Chamber-of-Commerce number, email domain, or a confirmation code we send). Fraudulent claim attempts lead to an immediate block.
Right of withdrawal for subscriptions: When entering into a paid subscription (Starter, Growth, Pro, Coach Pro, Lead Intelligence), you have a 14-day right of withdrawal, unless at the time of purchase you expressly waived this right to allow the service to start immediately. In that case, the right of withdrawal lapses once the service has been provided. You can cancel your subscription at any time via the Owner Dashboard (Settings → Billing → Cancel subscription) or by contacting info@indezon.app. Cancellation takes effect at the end of the current billing period.
Prices and VAT: All subscription prices are exclusive of 21% VAT unless stated otherwise. The final price including VAT is shown when completing the subscription via Stripe.
5. Liability
The shadow calculations and sun forecasts from In the Sun are indicative and based on astronomical models and available building data. We do not guarantee the accuracy of these calculations. Weather conditions, temporary obstacles and other factors may affect reality.
In the Sun is not liable for damage resulting from:
- inaccurate or incomplete sun calculations;
- failure of terrace owners to honour reservations;
- temporary unavailability of the Service;
- damage resulting from use of the Service in breach of these terms.
The liability of In the Sun is in all cases limited to the amount you have paid for the Service in the past 12 months (for a free service: nil).
6. Intellectual property
All rights to the Service, including the software, design, sun calculations and content, belong to In the Sun or its licensors. It is not permitted to copy, distribute or otherwise use any part of the Service without express written consent.
Photos and text that owners upload via the cockpit remain the property of the owner. By uploading, the owner grants In the Sun a worldwide, royalty-free licence to display this material within the Service and in marketing around the Service.
7. Applicable law
These terms of service are governed by Dutch law. Disputes arising out of or in connection with these terms will be submitted to the competent court in Amsterdam, unless mandatory law designates another court.
8. Changes
In the Sun may amend these terms of service at any time. Substantive changes will be announced at least 14 days in advance via the app or by email. By continuing to use the Service after the amended terms take effect, you accept the new terms.
10. Nature of the Service, indicative only
In the Sun provides an indication of how much sun and shade falls on terraces. We do our best to be as accurate as possible, but we cannot guarantee 100% accuracy. Factors that may cause the actual situation to differ locally:
- Trees, planting, parasols, awnings and temporary obstacles not present in our 3D data.
- Local cloud cover or fog banks that are not picked up by our weather data.
- Changes to the terrace layout (moved tables, new awning).
- Missing or incorrect building data from third parties (e.g. the Dutch Kadaster).
Treat In the Sun as a compass, not a map. When in doubt: walk past.
